How do I go to small claims court on an auto accident?

My husband was in an auto accident. Somebody ran a red light and hit him, but this guy didn’t have auto insurance. Our insurance company is telling us to go to small claims because we didn’t have collision on our insurance, but we are not sure what to do. There’s not a lawyer around where we live that does small claims.

You can look online at the website for your county clerk. There should be procedures or info to advise you how to file a claim with the courts.

However, chances are you will not get anything out of this person. If they didnt have money to pay for insurance, they likely will not have the money to pay for your damages.

Simple. Just go to the local county courthouse and file. You will need the EXACT name and address of both the driver of the car, and the registered owner because you will be filing against both. You will have to have him served. It is best to have your local police, or sheriff do that. It’s a small fee, and it’s hard for him to say he wasn’t served if the police do it.

Suing him will not be your biggest problem, collecting from him will. However most judgments are valid fro 10 years, and can be renewed another 10. Surely within that time you can find some asserts to seize. If you simply cannot collect from him, at least with the judgment you can deduct the loss on your taxes.
