Last week my friend and I got into an auto accident. We were both drunk when she drove 86 mph into a telephone pole. We were taken by ambulence to the hospital. I had a severe concussion and whiplash. It is less than a week, and I am in severe pain still. I have been thinking about getting an attorney to help me out. I would just like to know anyones opinions on using an attorney. This accident happened in Oregon. They driver (my best friend) was charged with a DUII.

I’ve seen MANY examples of people getting sued for at-fault auto accidents here, from serious accidents to fender benders. There are also a lot of victims who have collected from auto accidents to varying degrees. But has anyone here ever lost an auto lawsuit where they had to pay out of their pocket above what the insurance limits could cover? I may be facing this situation in the near future so just curious as to what to expect.
BR, You are observing people whose cases have made it all the way to trial. How likely is that to happen in a case with no SERIOUS injuries? I hope not very. Otherwise, it would seem like anybody who was ever at fault in a serious accident would lose all of their assets. That does not seem fair. An accident is an accident.

I was in a serious roll over auto accident and the girl that hit us has state minumum insurance coverage so now my insurance has to come into play also. After all medical billls are paid I’m trying to figure out where the pain and suffering comes in and how a dollar amount is put on it. I have been in bed for 5 weeks because of this accident. I’m sure after all medical bills are paid there probably won’t be anything left to even go towards pain and suffering. The girl was only 18 that hit us and her insrance policy is only in her name. I am at least thankful she had insurance.

Me and my fiance were involved in an auto accident where the other driver was completely at fault. This accident happened over 2 1/2 years ago. I was pregnant at the time and my fiance had to have surgery and 6 months of therapy to rebuild his shoulder. We lost all of our income for 7 months. His medical bills and lost wages exceeded 100 thousand $. Now we are trying to settle and the insurance company offered to pay the medical bills,lost wages plus 5,000 dollars pain and suffering We are not trying to be greedy here but it seems like nothing compared to what was messed up by the accident. Our lawyer seems so non chalant about it. My fiance asked about the 3x the medical bills for pain and suffering and our lawyer told him it was a myth and not to expect more than what the ins. com. offered the 1st time. Does this seem fair…I’m seriously considering getting a 2nd opinion from a different lawyer…anybody been through the same kind of thing…what was the end result? Thanks!
We are not trying to make a profit off of it…but I had to basically be a caregiver to a grown man for 3 months while I was 7 -9 months pregnant…His doctors say he has permanent disability in his right arm/shoulder that could definitly cause probs later in life (we were only 23 when it happened) Not to mention we were financially set until this happened and when my daughter was born we had to borrow money just to buy the nessicitiys needed for her.
Our attorney isn’t offering any advice and the policy limit is $500,000 per person so $5,000 did seem silly to me
No…it doesn’t include lost earning potential

My husband and I were involved in an auto accident July 2006. Our car suffered over 10,000.00 damage. The other person assumed libility. Our car has been fixed. My husband was not injuried. I suffered servere brusing, neck and shoulder pain and I am receiving treatment, medical bills are already over 8000.00. I used all my sick time from work, 3 weeks total, and now I am using my vacation time.
We have an attorney but I just wanted an answer from Yahoo answers:)

I hard an auto accident on March 07.
I made a left turn at a Intersection at 10 mph and hit a 2007
Audi that is slightly damage to my 94 Caprice Chevy more damage was done to her Audi. No one was hurt. Police was notify. She had a witness. Now my insurance company say it was my fault also her insurance company since I have only 10,000 dollars in liability my insurance already paid her. Her insurance paid the other 15,000 which cover the total cost of 25,000 dollars. Her insurance company want to collect the other 15,000 from me. Then was her insurance for ? This sounds like extortion with her carrier. Is there a law saying I have to pay her insurance costs it was a dam accident. Since when and where does it say I have to pay for an accident that was pay by her insurance company. This is Extortion at the highest level.
Also at the intersection when it happen on her side of the road the stop sign was taken down. I was makin a left turn.
[Update] This happen in the state of New Jesey. My insurance is Liberty Mutual. I have photos of the accident. I hope I have a case with my lawyer.

6 months ago I was in fault for an auto accident. I am now being sued for $200,000 basically for pain and suffering, which is crazy to that extent because the injuries were not that severe. Both of us walked away from the accident. My insurance covers up to $100,000 so the leaves the rest to me. What typical happens in cases like this?

There was an auto accident with two vehicles. Vehicle 2 was at fault of the accident. However vehicle 1 was revoked of his liscence and did not have a liscence at the time of the accident. He was issued a 511.1A. Does it matter that driver one doesnt have a liscense?
