Can you sue a company for an auto accident cause by their faulty equipment?
Bree asked:
I was at a red light when a phone company employee rear ended me in a company vehicle. At the time of the accident I did not have any auto insurance.

Yup. You can sue the phone company for the repairs to your vehicle. The basic rule of thumb while driving is if you hit someone, it’s your fault. Since the person in the phone company vehicle hit you, it’s his/her fault, and the fact that it was a phone company vehicle makes it the phone company’s fault if the driver was on company business. While it is true that you could get in trouble for driving without insurance, it doesn’t change the fact that the other driver was at fault and you suffered damages. Get a lawyer and take them to court for the damage to your car and attorney fees.

Why sue? If the other person was at fault, they should pay the damages to your car. I would recommend that you get insurance as it may be the other way around next time and you would be up the creek without a paddle.

You may have a problem, since you were without insurance. Since you didn’t, you shouldn’t have been on the road, therefore the accident could have been avoided. You’ll need a lawyer to work this out for you.

Sure you can! In the US, you can sue anyone for anything. Doesn’t mean you’ll win.
The phone company employee is at fault . . . you’ll have to sue him and the company in small claims court, if damages are small enough, or in regular court if they aren’t.

You can sue anyone for any thing. Heck you could file a law suit against God if you wanted to…..but perfecting service may be a bit difficult.
However, you do not need to file a law suit. Just call up the phone company- tell them who you are and that one of their vehicles struck your’s in the rear and you would like to file a claim for your damage. They will either refer you to their insurance company or to the loss control person for their company.
Why did you not have any auto insurance? Do you think you are special and do not have to obey the same law as everyone else?
Typical…..you don’t think you should have to pay for insurance to protect other people but as soon as someone hits you the first thought you have is law suit.
